Buying at The Title Halo 1 Naiyang as a foreigner

Ownership. Thai law lets a foreigner own a condominium unit freehold while foreign ownership stays within 49% of the building’s floor area. Units outside the quota can be offered on a registered lease. The developer’s materials do not state the quota position at Halo 1, so we confirm the title for your unit in writing before you reserve.

Money from abroad. For a freehold unit in a foreign name, the money must come from abroad in foreign currency and be converted to baht by a Thai bank, which issues the Foreign Exchange Transaction (FET) form the Land Office asks for at transfer. Keep every bank record.

Buying a completed unit. You reserve a unit, sign the sale agreement and pay the balance at the transfer at the Land Office. Check the unit, the furniture list and the juristic person’s fees before you sign.

Independent lawyer. Have a Thai property lawyer of your own choosing check the agreements, the title, the permits and the quota position before you sign. We can recommend lawyers our clients have used.

Transfer costs. A freehold transfer at the Land Office usually involves a 2% transfer fee, 3.3% specific business tax or 0.5% stamp duty, and withholding tax, split as the contract says. A lease registration usually costs 1% of the total rent plus 0.1% stamp duty.
